This Privacy Policy outlines how Company collects, uses, and shares your personal information and the choices and rights that you may have in relation to information. 1. APPLICABILITY AND SCOPE
This Privacy Policy applies whenever your personal information is processed as part of our “Services”, which means when you visit our website located at www.thesolacompany.com, www.essentialfoodco.com, and all corresponding webpages, software applications, websites or mobile applications that link to this Policy (collectively “Site”), or when you communicate with us via email, texts, a webform or phone call, or in any other interactions with us on and offline, such as at events and pop-ups (collectively, the “Services”).
This Privacy Policy applies solely to information collected by Company and does not apply to information collected by any third party, including through any application or content (including advertising) that may link to or be accessible from the Site. Third parties you interact with may have their own privacy policies, and Company is not responsible for how those third parties use the information they collect. We encourage you to learn about the privacy practices of those third parties.
2. CHANGES TO THIS POLICY
We may change this Privacy Policy from time to time and we will notify you by revising the “Last Updated” date at the top of this Privacy Policy. If we change this Privacy Policy in a way that we believe materially affects how we process your personal information, we will provide you with advance notice such as via email or by posting a notice on our website. Unless otherwise required by laws in your residence, your continued access or use of our Services after receiving the notice of changes constitutes your acknowledgment that you accept the updated Privacy Policy.
3. INFORMATION WE COLLECT
Personal information is generally any information that relates to you, identifies you personally, or could be used to identify you. The types of personal information that we may collect about you, and the way we collect such information is described below. Depending on how you interact with us, we may collect your contact details, purchase and transaction information, account information, communications with us, device and browser information, approximate location inferred from IP address, marketing preferences, and information about how you use our Site.
Information You Provide Us. For us to provide our Services, you will need to provide us with certain information.
Customer Support. If you contact our support team through phone or online chat, we may collect the personal information that you choose to share with us.

Information We Automatically Collect.
Usage Data. When you browse our Services, we automatically collect log data such as your web request, Internet Protocol (“IP”) address, browser type, domain names, referring and exit pages and URLs, pages viewed and the order of these page views, the date and time you access our servers, length of visit, click-stream data, locale preferences, system configuration data and other diagnostic data. Device Information. When you use your desktop or mobile devices to access our Services, we may be able to identify and collect your device’s unique device identifier, MAC address, operating system, and your mobile device’s advertising ID.
Location Information. When you use our Services, we may infer the generic physical location and geographic regions of your device from your Wi-Fi, Bluetooth and other device settings. For example, your IP address may indicate your general geographic region. You may choose not to share your location details with us by adjusting your desktop device’s location services settings. Information from Third Parties.
We may receive personal information about you from third parties, such as Shopify, payment processors, marketing partners, analytics providers, social media platforms, event partners, and publicly available sources, where permitted by law. Where required by applicable law, we will obtain consent before collecting personal information from third parties or will rely on another lawful basis permitted by law.
4. HOW WE USE YOUR INFORMATION
We use your information for business and commercial purposes, including to provide the products and services you request, to perform customer service functions, for security and fraud prevention, for marketing and promotional purposes, and to perform analytics. (a) When We Work With Our Service Providers. We may disclose personal information to vendors and service providers that perform services for us, such as e-commerce platform services, payment processing, fulfillment, shipping, customer support, website hosting, cloud storage, analytics, and marketing support. These providers are authorized to use personal information only as necessary to provide services to us or as otherwise permitted by applicable law and subject to contractual obligations regarding confidentiality, security, and appropriate handling of personal information. (c) When We Work Together. We may share your personal information between and among other Company-affiliated organizations for purposes of management and analysis, decision making, and other business purposes.

We and our service providers may process, store, or access personal information in jurisdictions outside the province or country where you reside, including the United States and other jurisdictions where we or our service providers operate.

7. HOW WE MAY ALLOW OTHERS TO COLLECT YOUR INFORMATION
When you use our Site, we may allow third parties to collect device and usage information and location information across your different devices through cookies and other tracking technology. To Display Ads for Products or Services. To Understand the Use of Our Services. These service providers collect aggregate statistical usage data that is not matched or linked to any individual user.

We and third parties on our behalf may use cookies or similar tracking technologies (collectively, “Tracking Technologies”) to collect information automatically as you interact with our Services. These Tracking Technologies help us customize your experience, optimize our user experience, or provide you with advertisements of interest to you. We may also use Web Beacons, JavaScript, and Entity Tags to optimize your user experience.
Web beacons are small, transparent images that are embedded in web pages, applications, and emails that are sometimes called “clear gifs,” “single pixel gifs”, “page tags” or “web bugs.” We may use web beacons track the web pages you visit, to test the effectiveness of our marketing, and to find out if an email has been opened and acted on.
JavaScript are code snippets embedded in various parts of websites and applications that facilitate a variety of operations including accelerating the refresh speed of certain functionality or monitoring usage of various online components.
Entity Tags are HTTP code mechanisms that allow portions of the Site to be stored or “cached” within your browser and validates these caches when the website is opened, accelerating website performance since the web server does not need to send a full response if the content has not changed.
We may use Tracking Technologies for the following purposes:
Functionality. Some of these technologies are required to allow you to access and use our Site, and without them our Site would not work properly.
Performance Monitoring. Some of these technologies help us analyze and estimate traffic and assess the volume of use of services and functionality on our Site. We may use Shopify Audiences to help us show ads on other websites with our advertising partners to buyers who made purchases with other Shopify merchants and who may also be interested in what we have to offer. We also share information about your use of the Site, your purchases, and the email address associated with your purchases with Shopify Audiences, through which other Shopify merchants may make offers you may be interested in.

You may elect to receive text messages from us through our Messaging Service. We may use third party service provider(s) to provide our Messaging Service to you. You may opt-out of receiving commercial text messages at any time via the Messaging Service by responding to any of our text messages with the following reply: STOP.
Access, Correction, and Withdrawal of Consent. Subject to applicable law, you may request access to personal information we hold about you and request correction of inaccurate or incomplete personal information. You may also withdraw your consent to our collection, use, or disclosure of your personal information, subject to legal or contractual restrictions and reasonable notice. Cookies and Other Tracking Technologies. You may be able to reject cookies and other tracking technologies by adjusting the appropriate settings of you your browser. If you do not want us to deploy cookies in your browser, you may exercise your preference by modifying your web browser setting to either refuse some or all cookies, or notify you and ask for your permission when a website tries to set a cookie. If you want to learn the correct way to modify your browser settings, please use the “Help,” “Tools” or “Edit” menu in your browser or review the instructions provided by the following browsers: Google Chrome, Internet Explorer, Mozilla Firefox, Safari (Desktop), Android Browser, and Opera.
If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences, you can opt-out of interest-based targeting provided by participating ad servers through the Digital Advertising Alliance (optout.aboutads.info) or the Network Advertising Initiative (optout.networkadvertising.org). Analytics. We may use third-party service providers to monitor and analyze the use of our Site. Presently, we use Google Analytics. Google Analytics is a web analytics service offered by Google LLC (“Google”) that tracks and reports Site traffic. Google Analytics Opt-out Browser Add-on provides visitors with the ability to prevent their data from being collected and used by Google Analytics, available at: tools.google.com/dlpage/gaoptout.
If you disable or remove cookies, some parts of the Services may not function properly. Information may still be collected and used for other purposes, such as research, online services analytics or internal operations, and to remember your opt-out preferences.
Meta Pixel. We specifically incorporate “pixels” provided by Meta Platforms, Inc. on some Company Sites. This enables us to track user behavior after a user clicks on a Facebook ad and is redirected to our Services. By doing so, we can assess the effectiveness of Meta ads for statistical and market research purposes and sometimes retarget certain users. Meta stores and processes this data. It is important to be aware that Meta may associate this information with any of your Meta accounts and utilize it for its own promotional activities. 10. DATA SECURITY
We maintain administrative, technical, and physical safeguards appropriate to the sensitivity of the personal information in our custody or control. All personal information you provide to us is stored on our secure servers behind firewalls. In order to prevent unauthorized access or disclosure, we have put in place multi-layer physical, electronic, and managerial procedures to safeguard and secure the information we collect online.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site, you are responsible for keeping this password confidential. You should not share your password with anyone. We urge you to be careful about giving out information in public areas of the Site like message boards. The information you share in public areas may be viewed by any user of the Site.
Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Site. In particular, email sent to us may not be secure, and you should therefore take special care in deciding what information you send to us via email. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.
11. RETENTION
We retain personal information only for as long as reasonably necessary to fulfill the purposes for which it was collected, to provide our Services, to comply with legal obligations, to resolve disputes, and to enforce our agreements. We may retain certain information for longer periods where required or permitted by law.
When personal information is no longer required, we will securely delete, destroy, or anonymize it in accordance with our retention practices and applicable law.
12. CHILDREN’S INFORMATION
Our Services are not directed to children, and we do not knowingly collect personal information from children without appropriate consent where required by applicable law. Notice About “Do Not Track Settings”. SOLA does not currently take action in response to a “do not track” browser setting. SOLA will revisit this policy accordingly if an industry standard regarding such settings emerges.

Use of an Authorized Agent to Submit a Request. Only you or a person you formally authorize to act on your behalf, may make a verifiable consumer request related to your personal information as a California consumer. If you use an authorized agent to submit such a request, we will require written proof that the authorized agent has been authorized to act on your behalf or a copy of the power-of-attorney document granting that right.
California Shine the Light Law. In addition, California Civil Code §1798.83 permits customers of Company who are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. In your request, please specify that you want a “Company’s California Privacy Rights Notice.” Please allow 30 days for a response.
